That Paul Freeman is the present ownerand Freeman Environmental Services,
Inc.
is the operator (collectively
“Respondents”)
of
a
facility
located
at
720
North
Division
Street
in
Carterville,
Williathson
-
County,
Illinois.
The
property
is
commonly
known
to
the
Illinois
Environmental Protection Agency as Carterville/Freeman,
Paul.
.2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating Permit and
is designated with
Site Code No.
1990155027.
3.
That Respondents have owned and operated said facility at all times pertinent hereto.
4.
That on
August
15,
2005,
Garrison
Gross
of
the Illinois
Environmental
Protection
Agency’s Marion Regional Office
inspected
the above-described facility.
A copy of
his inspection
report setting forth
the results of said inspection
is attached hereto and
made
a part hereof.

VIOLATIONS
Based
upon direct observations made by Garrison Gross during the course of his August17,
2005
inspection
of
the
above-named
facility,
the
Illinois
Environmental
Protection
Agency
has
determined that Respondents have violated the Illinois Environmental Protection Act (hereinafter,
the “Act’) as
follows:
(1)
That
Respondents
caused
or
allowed
the open
dumping
of waste
in
a
manner
resulting
in
litter,
a
violation
of
Section 21(p)(l)
of
the Act, 415
ILCS
5/21(p)(1)
(2004).
(2)
That
Respondents caused
or
allowed
the
open dumping
of
waste
in
a
manner
resulting
in
open
burning,
a
violation
of
Section
21(p)(3)
of
the
Act,
415
ILCS
5/21 (p)(3) (2004).
(3)
That
Respondents
caused
or allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
deposition
of
general
construction
or
demolition
debris
or
clean
construction or demolition debris, a violation of Section 2l(p)(7) of theAct, 415 ILCS
5/21 (p)(7) (2004).
CIVIL
PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415
ILCS 5/42(b)(4-5)
(2004),
Respondents are
subject
to
a
civil
penalty
of
One
Thousand
Five
Hundred
Dollars
($1,500.00)
for
each
of
the
violations
identified
above,
for
a
total
of
Four Thousand
Five
Hundred
Dollars
($4500.00).
If
Respondents
elect
not
to
petition
the Illinois
Pollution
Control
Board,
the
statutory
civil penalty
specified above shall be due and payable no later than October 31,2005, unless otherwise provided
by order of the Illinois
Pollution
Control
Board.
If Respondents elect to contest this Administrative Citation by petitioningthe Illinois

Affiant is a field inspector employed by the Land Pollution
Control Division of the
Illinois
Environmental Protection Agency and has been so employed at all
times pertinent hereto.

inspection of a disposal site operated by Paul A. Freeman, located in Williamson County,
Illinois, and known as Carterville/Freeman, Paul by the Illinois Environmental
Protection
Agency.
Said site has been assigned site code

by the Agency.

Affiant inspected said Carterville/Freeman, Paul site by an on-site inspection which
included walking and photographing the site.

General Remarks:
An Open Dump
Site Inspection was conducted
on Monday,
August
15,
2005
at
the property ofPaul Freeman.
Garrison Gross and Gerald Steele ofthe Illinois EPA Bureau of Land
conducted the
inspection.
The property is
located at
720 North Division
Street in
Carterville, Illinois,
62918.
The
inspection was performed
as a follow
up
to two
telephone complaints (C-06-020, C-06-
023).
The complainants alleged that
open dumping and
open burning of construction and demolition
debris was occurring
at
the
site.
Weather
conditions
at the
time
of the
inspection
were
scattered
clouds, 77°F, and a calm wind.
The inspection
began at
10:20
AM.
Garrison Gross
and
Gary Steele
of the Illinois
EPA
Bureau of
Land
entered
the
site and
observed
evidence of open burning and
open
dumping.
Upon
arrival,
we
observed
3 piles of construction and
demolition
waste in
the southeast portion of the property (photo
009).
The waste was near the onsite
commercial
building
and
close to
the entrance to the
property.
This
waste
included
but
was
not
limited
to bricks,
mortar,
soil,
and
fragments of processed
lumber.
More
construction
and
demolition
waste
was
observed
along
the
northern
border
of the
property
(photos 001-004).
This waste consisted ofsimilar composition.
Smoke was rising from the waste piles
on the northern border ofthe property.
Upon further observation, flames were observed rising from the burning waste that was dumped in the
ditch (photos 005
and 006).
The flames were
located
in the middle
and
bottom
portion of the waste
pile.
Two green garden hoses were stretched across the property from the commercial building to the
waste pile (photo
007): The hoses suggest
that someone had prepared tO
burn the waste and use water
to
control the
fire.
Both areas containing the open dumped waste
appeared to
have been
abandoned
strip
mining pits.
The wastes were dumped onto the edge ofthese pits.
Another concern was
an area
in the west central portion of the property.
We observed
some
disturbed soil
with processed
lumber,
partially burned,
and concrete block commingled with
it (photos 012 and
013).
It appeared that some
waste may have been buried on the site at an
earlier date.
Twenty-three plastic
drums were observed
in the southeast portion ofthe property (photo 010).
Some ofthe drums were labeled as “hazardous”.
Fifteen of the drums
contained
unknown
liquids.
One
drum was missing
the
lid and
contained
an
unknown green
liquid
(photo
011).
A Freeman Environmental
trailer was photographed
at the site
(photo 008).
Approximately 480
cubic yards of
waste
was observed at the site.
The
inspection
ended
at
approximately
10:45
AM.
Approximately
480
cubic yards of waste
was
observed at the
site.
The owner ofthe property was identified through tax records from the Supervisor
of Assessment’s
Office
in
Williamson
County.
Later
that
day,
Mr.
Freeman
was
informed of the
complaints via telephone.
He asked to
meet with Agency
personnel that afternoon.
Gary Steele and
Tom Edmondson returned to site to meet with Mr. Freeman.

Freeman
has worked
in the environmental field since
1977 where as an Illinois
State Trooper; he worked as a hazardous materials officer having received
extensive training
inall fields of hazardous materials. After retiring from

Illinois State Police,
he started a second
career in the hazardous materials
industry. He was employed by Central States Environmental services as a
project manager and traveled across
the
country
in this capacity.

Derek Freeman, and

Paul works closely with the staff of Freeman
Environmental
Services,
Inc. lending
his experience and expertise to achieve client objectives.
Paul
is an avid quail hunter and enjoys fishing as often as possible.

OSHA Construction Outreach Trainer,

Materials Site Operator and has received 80 hour Hazardous Emergency

Daughter Darrian and his youngest daughter Lauren.

B.S.I
from the University of Arkansas, Little Rock. Bob has accumulated several
certifications
in the emergency response/environmental fields.
He trains local
police, fire, medical and
response personnel
in areas of mitigation,
preparedness,
response, and
recovery.
Bob works with Freeman
Environmental
Services, inc. as a consultant,
hazmat project manager and trainer.
Dr.
Billy
Fairless, retired
in 2004 as Associate
Professor of Chemistry, SIU,-
Carbondale,
IL.
Billy earned
a BA in Chemistry from
SIUC in 1963,
an
MS in
Biophysics from
the University of Houston in 1967,
a
Ph.D.
in Biophysics from
the University of Houston
in 1968 and his post graduate research
in Chemistry
from
Princeton
University in 1967-68.
Billy retired from
U.S. Environmental
Protection Agency in
1999.
Billy has many accomplishments and experiences in
the environment field and has received many awards and has several
publications. Freeman
Environmental
Services,

be utilizing Dr. Billy
Fairless as a consultant and project manager.

Bruce
Talley, retired from AmerenCIPS in 2001.
Bruce has been Fire
Chief for the City of Carterville since
1999,
as well as an Emergency Medical
Technician.
He works on a part time (as needed
basis) with
Freeman
Environmental Services, Inc. as a Hazardous Materials Technician. Bruce has
received
training
in first aid, advanced CPR, excavation, OSHA substation
training, emergency response to terrorism, explosives training,
lead abatement
and has trained and worked with
Illinois State Police,
Secretary of State, and
hold
a degree
in Engineering Technology from Southern
Illinois
University,
Carbondale.
Bruce enjoys scuba diving, sailing and amateur radio.
Phil
Jeralds, retired from the
Illinois State Police, works as an Environmental
Consultant Manager for Freeman
Environmental Services, Inc.
Phil is licensed by
the State of Illinois as an Asbestos Contractor/Supervisor and a Lead Abatement
Supervisor.
He has received training in
Mold Remediation, has been certified
in
40 hour Hazwopper training to respond as a Hazardous Materials Technician for
emergency responses and methamphetamine lab clean-ups. Phil enjoys
camping
with his wife, Cheryl,
NASCAR racing and his horses.
Mr. John Fisher, has been a chemistry professor at Rend
Lake College
for over
20 years.
He helped
in the development of an award winning environmental-
science
project with
Ewing Northern Grade School.
This project
involved the
IEPA, Army Corps of Engineers and other agencies. Rend
Lake was
used as
a
“living laboratory” for the water tests conducted. He has also been responsible
for
securing numerous grants,
developing research projects, and serving as a
consultant for Freeman
Environmental
Services, Inc. on numerous proje~s.
Keith Thomas, Project Manager for Freeman
Environmental
Services,
Inc. has
extensive experience in managing
and supervising multi-million dollar
construction projects.
In his over 20 years experience
in heavy-highway and
commercial
building projects he has ensured
the
quality, accuracy and timely
completion of many earthwork projects. He
is able to coordinate many facets of a
project, ensure timely completion of a fast track schedule, control
budget, ensure
