    HEARING OFFICER ORDER
     
    On October 5, 2005, the parties participated in a telephone status conference with the
    hearing officer. Petitioner will soon file a motion for summary judgment in this matter.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 10:30 a.m. on January 3, 2006. The status conference shall be initiated by the
    petitioner.
     
    Petitioner filed an open waiver of the decision deadline in this case.
