HEARING OFFICER ORDER
On September 29, 2005, the parties were scheduled to participate in a telephone status
conference with the hearing officer. Neither party appeared. As last reported, respondent was
supposedly close to issuing the closure permit. Petitioner is ordered to file an additional waiver
of the decision deadline no later than October 20, 2005.
The hearing officer notes that petitioner has been filing very short deadline waivers for
several years despite the fact that little progress is made on a monthly basis. This requires
significant time and attention by the hearing officer to closely monitor this case. Accordingly, if
petitioner does not withdraw this appeal or file an open waiver of the decision deadline by
December 31, 2005, the hearing officer reserves the right to set this case for hearing.
The parties are directed to participate in a telephone status conference with the hearing
officer at 11:00 a.m. on October 20, 2005. The status conference shall be initiated by the
petitioner.
The decision deadline is currently January 20, 2006.
