HEARING OFFICER ORDER

On September 15, 2005, all parties participated in a telephonic status conference with the

hearing officer. The parties represented that discussions continue and that the parties continue to

explore all options regarding the rebuilding of the Lemont plant. The petitioner will draft a

modified permit and submit it to the respondent for review prior to the next status conference.

The parties are directed to participate in a telephonic status conference with the hearing

officer on December 15, 2005, at 10:00 a.m. The telephonic status conference must be initiated

by the petitioner, but each party is nonetheless responsible for its own appearance. At the status

conference, the parties must be prepared to discuss the status of the above-captioned matter and

their readiness for hearing.
