    HEARING OFFICER ORDER
     
    On September 8, 2005, the parties were scheduled to participate in a telephone status
    conference with the hearing officer. Again, neither party appeared. If petitioner’s attorney is
    unable to attend the next status conference, he is directed to contact the hearing officer in
    advance to discuss the status of this appeal. As last reported, the environmental consultant was
    going to be contacted to determine the necessity of maintaining this appeal.
      
    The parties are directed to participate in a telephonic status conference with the hearing
    officer at 1:30 p.m. on October 4, 2005. The telephone status conference will be initiated by the
    petitioner.
     
    Petitioner filed an open waiver of the decision deadline in this case.
