The Illinois Environmental Protection Agency (“Illinois EPA) hereby
gives notice of a variance petition filed by Silbrico Corporation (“Silbrico”) with
the Illinois Pollution Control Board (0Board”) on Ju!y 19,2005 (Docket No. PC8
06-011). Siltrico. located at 6300 River Road, Hodgkins, Illinois, (Cook County),
has filed a petition for variance under Title IX of the Environmental Protection Act
(“Act). Variances may be granted by the Board pursuant to Section 35 of the Act
(415 ILCS 5/35 (2004)) and 35111. Adm. Code Part 104 of the Board regulations.
The petition requests a variance from the provisions of Pans 810
through 817 of the Board regulations, 35111. Adm. Code Parts 810 through 817,10
the extent those Parts require disposal of oft-specification penile and fugitive penlite
generated by Silbnico’s manufacturing process in a non-hazardous waste landfill.
Silbrico currently disposes of the wastes in a permitted non-hazardous municipal
waste landfill, but it wishes to dispose of the off-specification and fugitive penlite
at locations where construction and demolition debris is being used as fill material.
Any person may request a hearing in this matter by filing a written
objection to the grant of the variance with the Board, together with a written request
for a hearing; within twenty-one (21) days after the publication of this Notice (by

A copy of the varIance petition is also available through the Clerk of the Board.
The Illinois EPA is preparing a recommendation regarding the varianCe
petition. The Illinois EPA is to file its recommendation within forty-five (45) days
after the filing of the petition. The Illinois EPA solicits comments from persons who
may be adversely affected by the variance. Address any comments or inquiries to:

for the Clerk of the Board. Th.e record of this proceeding will remain open for
written comments for forty-five (45) days after the filing of the Illinois EPA
recommendation.
The record in this variance proceeding is available at the Board office
for Inspection by the public, except for those portions of the record that are protected
from disclosure under 35111. Adm. Code Part 130. Procedures are available
whereby disclosure may be sought by the public.
