HEARING OFFICER ORDER
On August 4, 2005, respondents filed a motion for extension of time to respond to
complainant’s motion for summary judgment. The hearing officer, however, construed the
motion for extension of time to pertain only to respondent Community Landfill Company, Inc.
(CLC). On August 18, 2005, the hearing officer granted, in part, CLC’s motion for extension of
time. On August 23, 2005, the respondent, City of Morris (City), informed the hearing officer
that the motion for extension of time was filed on behalf of both respondents. It is noted that the
motion itself contained varying references to “respondent” and “respondents” throughout. The
City, however, did sign the motion, indicating that it likewise was moving for an extension. To
that end, the City is also granted the extension of time to the extent that the City’s response to
the complainant’s motion for summary judgment is now due on or before September 16, 2005.
No further extensions will be entertained without just cause.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on September 13, 2005, at 11:00 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
