Af’fiant, Joy K. Bliton, being first duly sworn, voluntarily deposes and states as follows:
1.
Affiant is a field inspector employed by the County ofOgle and has been so employed at
all times pertinent hereto.
2.
On December 29, 2004, Steve Rypkema and Affiant conducted an inspection ofan open
dump operated without an Agency permit, located at 1192 E. Illinois Route 64, Oregon, in
Ogle County, Illinois and known as OregonIron Metal Reclaimers, Inc., resulting in an
Administrative Citation Warning Notice with a compliance deadline of March 31, 2005.
3.
On June29, 2005, between 10:25 a.m. and
10:55
am., Affiant conducted an inspection of
an open dump operated without an Agency permit, located ~ 1Th2t. Illinois ROute 64,

Oregon, in Ogle County, Illinois and known as Oregon Iron Metal Reclaimers, Inc., by
the Ogle County Solid Waste Management Department. Said site has been assigned Site
Code No. 1418175004 by the Agency.
4.
Affiant inspected said Oregon Iron Metal Reclaimers, Inc., open dump site by an on-site
inspection which included walking and photographing the site.
5.
As a result ofthe activities referred to in Paragraph 4 above, Affiant completed the
Inspection Report form attached hereto and made a part hereof, which, to the best of
Affiant’ s knowledge and belief, is an accurate representation of Affiant’ s observations and
factual conclusions with respect to said Oregon Iron Metal Reclaimers, Inc., open dump
site.

This Administrative Citation is issued pursuant to authority vested in the Illinois
Environmental Protection Agency by 415 ILCS 5/1
et. seq.
(1996), specifically 415 ILCS 5/31.1.
FACTS
1.
The Respondent, Tommy Ray Ramando, is the present operator ofa facility
located in the County of Ogle, State ofIllinois.
2.
The facility is an open dump, operating without an Illinois Environmental
Protection Agency Operating Permit, and designated with the Site Code #
1418175004. The facility is known to the Agency as the Oregon Iron Metal
Reclaimers, Inc. site.
3.
That respondent, Tommy Ray Ramando, has occupied, controlled and/or operated
the facility at all relevant times hereto.
4.
That on December 29, 2004, Joy K. Bliton, Field Inspector and Steve Rypkema,
Director, Ogle County Solid Waste Management Department, inspected the
facility. Violations noted included 4 I 5 I U’S 2 (a). 2 I (d), 2 1 (p)( I), 21 (p)(7) and
55(a)( 1). An Administrative Citation Warning Notice was sent to the tollowing

individuals with a compliance deadline of March 31, 2005: David Jacobson,
Tommy Ray Ramando, Neil Moen, Schrnack & Petruchius, Attorneys at Law.
That on June 29, 2005, Joy K. Bliton, Field Inspector, Ogle County Solid Waste
Management Department, inspected the facility. A true and correct copy of the
inspection report, along with an affidavit are attached.
VIOLATIONS
On the basis ofField Inspector, J. K. Bliton’s direct observation, she has determined that
the Respondent has caused or allowed open dumping at the above described facility in a manner
that resulted in the following violations:
That on June 29, 2005, an on-site inspection ofthe facility disclosed the following:
1.
The Respondent has caused or allowed littering at the facility in violation of
415 ILCS 5/2l(p)(l).
2.
The Respondent has caused or allowed the deposition of general construction
or demolition debris, or clean construction or demolition debris in violation of
415 ILCS S/2l(p)(7).
CIVIL PENALTY
In accordance with 415 ILCS 5/42 (b)(4), the Respondent is subject to a civil penalty of
$1,500.00 for each violation specified above in paragraph 1. This is a total of$3,000.00 for this
Citation. Additionally, should the Respondent elect to petition the Illinois Pollution Control
Board under the review process described below, atier an adjudicatory hearing, the Respondent

shall be assessed the hearing costs incurred hv the Pollution Control Board. The hearing cost
would be in addition to the $3,000.00 finc.
If you acknowledge the violations cued herein above, the civil penalty shall he due and
payable no later than 35 days from the date of service hereof. If you do not petition the Pollution
Control Board for review ofthe Administrative Citation within 35 days of service ofthe
Administrative Citation, or contest the Citation, any judgment that may be rendered against you
shall specif~’the due date of the civil fine and any additional costs assessed against you.
When payment is made, your check should be made payable to the Ogle County Solid
Waste Fund and mailed to the attention of John Coffinan, Ogle County Treasurer, Ogle County
Courthouse, Oregon, Illinois, 61061. Also, please complete and return the enclosed remittance
form, along with your payment, to assure proper credit.
If any civil penalty is not paid within the prescribed time, the law allows for the
accumulation and payment ofinterest on the remaining unpaid balance. If any civil penalty is
not paid when due, the Office ofthe State’s Attorney shall be requested to initiate proceedings in
Circuit Court to collect the penalty. In addition to the civil penalty, hearing costs, and interest, if
any, the Ogle County State’s Attorney may seek to recover theircosts oflitigation.

I arrived at Oregon Iron Metal Reclaimers, Inc. at 10:25 a.m. I stopped by the office and
told
them I
was here for
an inspection. I walked up to the wooded area and looked at the pile of
capacitors. These PCB containing capacitors are the subject of a separate investigation being
conducted by the IEPA and USEPA, and will be addressed by them.
There were old barrels around the area that I had not seen at the last inspection. I continued into
the woods and noted many tires and barrels along the way. I walked back down on the other
roadway leading
to the northwest corner ofthe site.
At the last inspection on
December 29, 2004, scrap metal and tires were buried. This waste,
along with plywood, vinyl, plastic, carpeting,
metal springs, car parts and demolition waste,
continues to be buried and has not been cleaned up. The leveled area
has expanded to the
northwest. Waste was sticking out from the
bank
and from the leveled area.
I walked to the south side of the site. A tire was sticking out from the berm. I
walked around the
scrap pile which has grown considerably, especially in white goods. I did not see any evidence
that Freon is being removed from the appliances.
I walked back to the truck and left at 10:55 am.

To contest the Administrative Citation you have received you must follow the
instructions provided in the Administrative Citation. You may be served with
additional Administrative Citations if you fail to complete the following
corrective actions, and are found to be in violation ofSection 21(p) of the Illinois
Environmental Protection Act. Additional inspection(s) will be conducted to
verify cleanup and compliance.
YOU MUST COMPLETE THE
FOLLOWING CORRECTIVE ACTIONS:
#1
Immediately cease all open dumping and burial ofwaste.
#2
By September 30, 2005, remove all non-hazardous waste, including all
buried waste, to a permitted landfill or transfer station. Scrap metal not
disposed at a landfill can be taken to a scrap metal facility or recycling
center.
Please note: Iflocal ordinances allow a salvage business at your
location, the scrap metal should be kept organized, and moved off-
site on a regularbasis. NO burning of waste, including the burning
of insulation offof metal wire, or open dumping of automotive
fluids is allowed.
Tires may not be taken to a landfill, they must be taken to a registered tire
storage or disposal/recycling facility.

#3 By October 7, 2005 submit to the Ogle County Solid Waste Management
Department copies of receipts that document the proper disposal or
recycling of the wastes.
Any written response submitted in reply to the Corrective Action required in this
attachment must be sent to:
