HEARING OFFICER ORDER
On August 23, 2005, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that settlement discussions continue with a stipulation
and proposal for settlement (stipulation) being reviewed. The complainant represented that it
will file an amended complaint with the new violations being incorporated therein. To that end,
respondent’s answer due date of August 31, 2005, is stricken. The complainant is directed to file
its amended complaint on or before October 14, 2005. The respondent is directed to answer or
otherwise plead to the amended complaint on or before October 31, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on October 6, 2005, at 9:15 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
