HEARING OFFICER ORDER
On August 18, 2005, all parties participated in a telephonic status conference with the
hearing officer. Complainant and respondent Battest Construction Company of Illinois, Inc. are
discussing ability to pay the penalty demand. Financial documents are being reviewed. The
Parties represented that discovery is proceeding. The attorney for respondent 4832 S.
Vincennes, L.P., was again reminded to file his appearance.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on November 3, 2005, at 10:45 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
