HEARING OFFICER ORDER
On August 23, 2005, petitioner participated in a telephone status conference with the
hearing officer. Respondent did not appear. Petitioner has some issues regarding the proposed
permit’s flexibility with respect to operating temperatures, and is waiting to hear from
respondent’s permitting unit. Petitioner agreed to file an open waiver of the decision deadline
within the next seven days.
The parties are directed to participate in a telephone status conference with the hearing
officer at 9:00 a.m. on October 25, 2005. The status conference shall be initiated by the
petitioner.
The decision deadline is currently December 1, 2005.
