HEARING OFFICER ORDER
On July 21, 2005, the complainant filed a motion for summary judgment. On August 4,
2005, the respondent, Community Landfill Company Inc., (CLC), filed a motion for an extension
of time to file its response, to and including October 11, 2005. On August 10, 2005, the
complainant filed a response to CLC’s motion. Complainant objects to the extension to October
11, 2005. The complainant, however, has no objection to a September 6, 2005, extension of
time. It is noted that the respondent City of Morris is not a part of the motion for an extension of
time, nor has it filed a response to the motion for summary judgment.
I have reviewed the motion for an extension of time and the complainant’s response. I
find no compelling reason why CLC needs the additional time, to and including October 11,
2005, to file its response to the motion for summary judgment. I do find, however, that an
extension of time to and including September 16, 2005, is reasonable. Therefore, CLC’s motion
for an extension of time is granted to the extent that its response to complainant’s motion for
summary judgment is now due on or before September 16, 2005. No further extensions will be
entertained without just cause.
The parties or their legal representatives are directed to participate in a telephonic status
conference on September 13, 2005, at 11:00 a.m. The telephonic status conference must be
initiated by the complainant, but each party is nonetheless responsible for its own appearance.
At the status conference, the parties must be prepared to discuss the status of the above-
captioned matter and their readiness for hearing.
