HEARING OFFICER ORDER
On August 18, 2005, the parties participated in a telephone status conference with the
hearing officer. Settlement negotiations have taken a setback, as respondent is now considering
expansion of the car wash. Complainant refuses to waive future rights to file a complaint
regarding any newly expanded areas, which was one of respondent’s conditions for building the
noise wall. At respondent’s request, complainant agreed to speak to his noise expert regarding
the possible impact of the expanded area.
The parties are directed to participate in a telephone status conference with the hearing
officer at 9:00 a.m. on September 20, 2005. The telephone status conference will be initiated by
the complainant.
