HEARING OFFICER ORDER
On July 28, 2005, all parties participated in a telephonic status conference with the
hearing officer. The complainant represented that the related issue that is anticipated to resolve
this matter is proceeding accordingly and that the application process has been completed before
the Village of Elgin. The permit, however, is not expected to be issued prior to the next status
conference. The parties represented that discussions continue regarding the possibility of filing a
motion to voluntarily dismiss this matter and requested that that any telephonic status
conferences and rulings in this matter, including the fully briefed and pending cross-motions for
summary judgment, be continued for an additional 120 days. That request is granted.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on December 8, 2005, at 10:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
