HEARING OFFICER ORDER

On July 26, 2005, the parties participated in a telephone status conference with the

hearing officer. The parties anticipate changes at the facility by the end of the year that will

eliminate the need for this appeal.

The parties are directed to participate in a telephone status conference with the hearing

officer at 10:00 a.m. on October 27, 2005. The status conference shall be initiated by the

petitioner.

Petitioner has filed an open waiver of the statutory decision deadline for this case.
