FACTS

ThatRespondent, Harriet Baugher and John Baugher, is the present owner and/or operator of property located in
Miller Township,
LaSalle County, Illinois.
2.
That said ilcility is an open dump, operating without an illinois Environmental Protection Agency Permit, and
designated with Site Code No. 0998205005.
Said facility is
commonly
known to the Agency as the Baugher
Property.
3.
That the Respondent has owned and/or operated
said facility since April, 2003.
4.
That on June 28,2
005, Christy Vargochik, Landfill Inspector, LaSalle County Department of
Environmental
Services and Development, under the authority ofthe Illinois Environmental Protection Agency,
inspected the abovedescribed facility.
A copyofthe inspection reports setting forth the results of such
inspections are attached hereto and made a part hereof.

is subject to a civil penalty of Fifteen Hundred Dollars ($1500.00) foreach violation specified above in Paragraph
5(b) for a total ofFifteen Hundred Dollars ($1500.00).
Additionally, should Respondent elect to petition the
Illinois
Pollution Control Board under the review process described herein below, and if there is
a finding of
the violation alleged herein, afteran ad judicatory hearing, Respondent shall be assessed the associated hearing
costs incurred by the Illinois
Environmental Protection Agency and the Illinois
Pollution Control Board,
in
addition to the Fifteen Hundred Dollar ($1500.00) statutory penalty for each finding ofviolation.

Ifyou acknowledge the violations cited herein above, the civil penalty specified above shall be due and payable
no later than thirty-five (35) daysfrom the dateofservice hereof.
Ifyou do not petition the Illinois Pollution
Control Board ofreview ofthis Administrative Citation within thirty-five (35) days ofservice hereofor if you
elect to contest this Administrative Citation, any judgment rendered against you shall specify the due date of
the statutory civil penalty and any costs assessed against you.

civil penalty,
by reason of acknowledgment, default or finding after the
adjudicatory hearing is not paid when due, the LaSalle County State’s Attorney may initiate proceedings in
Circuit Court to collect said civil penalty.
In addition to the previously assessed civil
penalty, interest and
hearing costs ofthe Illinois Pollution
Control Board, ifany, the State’s Attorney’s Office
will seek to recover
their costs of litigation.

and 6:30 a.m., Affiant conducted inspections ofa disposal/storage site
operated without an Agency permit, located in LaSalle County, Illinois and known as
the Baugher
Property
by the
Illinois Environmental Protection Agency.
Said site has been assigned site code number 0998205005
by the
Agency.

Affiant inspected the said Miller Township
/ Baugher Property open dump site
by
an on-site inspection which
included driving and photographing the site.
4.
As a result ofthe material actions referred to in paragraph
3 above, Afflant completed the Inspection Report
Forms attached hereto and made a part hereof, which, to the bestofAffiant’s knowledge and belief,

A solid
waste
landfill inspection was
performed on
June 28,
2005,
by
Christy Vargochik representing
the Lasalle County
Department
of Environmental Services
and
Development under the delegated
authority
of the-IllinoisEnvironmental
Protection
Agency atthe
property
of
Harriet
Baugher.
The
property
is located at 3451
E.
25th
Road, Section 8, Miller Township, Marseilles,
Illinois.
During
the
inspection
the following
was
noted:
causing or allowing open dwnping; disposing
and storing
of
waste
at a site
not meeting requirements of the
Act and
Regulations;
causing
or allowing the open
dumping in-a mannerwhicltisse&ulting in litter
at the dump site, causing or allowing the
open dumping
of
waste tire
and;
Ihilure
to submit an application for a
permit
to develop
and operate
a landfill.
Weather conditions
noted
on
arrival were sunny and approximately
75 degrees.
I
arrived
at the
site
at
6:25 a.m.
I conducted the
inspection from
the
road.
I
began
at the
south
endof the Baugher property,
and
could
see that
the yard to the south still
contained
several
cars (photo
987.57).
1
continued by driving to the north. I noticed afew
more vehicles
immediately southof the house (photo 987.58).
I went about
5
feet to the
north, and
photographed the limo parked
on the easement(photo 987.59).
1 noticed anothersilver
car parked about
5
feet
north ofthe limo (photo 987.60).
1 photographed
three more vehicles
in front of the
house, and noticed that two
of the vehicles are new to the
property
(photo 987.61).
1 went
another 20
feet
to the north, and photographed anothersilver car parkedon the easement,
and
partially
obscured
by vegetation
(photo 987.62).
This concluded the inspection,
and
I left the site at6:30 a.m.
