HEARING OFFICER ORDER
On July 22, 2005, the petitioner informed the hearing officer that it is proceeding with
internal discussions that may resolve the above-captioned appeal. Discussions include the
selling of the site and responsibility for remediation. The petitioner represented that it will file a
waiver of the statutory decision deadline.
The parties are directed to participate in a telephonic status conference with the hearing
officer on September 29, 2005, at 1:00 p.m. The status conference must be initiated by the
petitioner, but each party is nonetheless responsible for its own appearance. At the status
conference, the parties must be prepared to discuss the status of the above-captioned matter and
their readiness for hearing. If, however, a motion to voluntarily dismiss is filed prior to the next
status conference, the conference will be cancelled without further order.
