HEARING OFFICER ORDER

On July 21, 2005, all parties participated in a telephonic status conference with the

hearing officer. The parties represented that the Illinois Environmental Protection Agency is

reviewing a settlement offer from the respondent that does not include a supplemental

environmental project (SEP). In lieu of the SEP, an increased penalty would be offered. To that

end, respondent’s answer is now due to be filed on or before September 30, 2005.

The parties or their legal representatives are directed to participate in a telephonic status

conference with the hearing officer on September 15, 2005, at 9:15 a.m. The telephonic status

conference must be initiated by the complainant, but each party is nonetheless responsible for its

own appearance. At the status conference, the parties must be prepared to discuss the status of

the above-captioned matter and their readiness for hearing.
