HEARING OFFICER ORDER
On July 21, 2005, all parties participated in a telephonic status conference with the
hearing officer. The parties appeared optimistic that a settlement will be reached, with the
respondent awaiting a no further remediation letter from the Illinois Environmental Protection
Agency. Another issue that is outstanding is a terms of payment issue.
The respondent represented that it will file a motion for leave to file its answer and
answer instanter on or before August 11, 2005. The complainant will have 14 days to respond.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on October 20, 2005, at 9:45 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
