HEARING OFFICER ORDER
On July 14, 2005, all parties participated in a telephonic status conference with the
hearing officer. The respondent represented that it has recently forwarded a counter-offer to the
complainant for review. The counter-offer includes a supplemental environmental project,
which the Illinois Environmental Protection Agency has asked for further information. By
agreement, complainant is directed to file its response to the respondent’s affirmative defenses
on or before October 21, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on September 29, 2005, at 9:30 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
