HEARING OFFICER ORDER
On July 14, 2005, all parties participated in a telephonic status conference with the
hearing officer. The petitioner represented that it has been discussing issues such as modifying
conditions in the draft permit. The parties also represented that the Illinois Department of
Nuclear Safety (DNS) has reviewed a condition in the draft permit as well, including radium
levels. The petitioner represented that it will review the DNS report and continue discussions
with the respondent. Petitioner represented that it will file a 80-day waiver of the statutory
decision deadline.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on September 22, 2005, at 9:30 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a motion to voluntarily
dismiss is filed prior to the next status conference, the conference will be cancelled without
further order.
