    HEARING OFFICER ORDER
     
    On June 28, 2005, a hearing in this matter was held at the James R. Thompson Center,
    100 West Randolph Street, Room 11-512, Chicago, Illinois. Attorneys Kathleen Bassi and
    Kavita Patel appeared and participated on behalf of the petitioner. Attorney Charles Matoesian
    appeared and participated on behalf of the Illinois Environmental Protection Agency (Agency).
     
    Witness Credibility
     
    Both parties presented witnesses. Based on my observations, experience and legal
    knowledge, witness credibility is not an issue.
     
    Exhibits
     
    The petitioner offered one exhibit at the hearing. It was entitled “Estimate of Controlled
    Emissions, Tons Reduced, and Cost Effectiveness of Controls”. Petitioner’s exhibit was
    admitted without objection as petitioner’s exhibit 1.
     
     
    Briefing Schedule
     
    At the hearing, a post-hearing briefing schedule was discussed and agreed to. The
    petitioner’s post-hearing brief is due to be filed on or July 25, 2005. The Agency’s post-hearing
    brief is due to be filed on or before August 8, 2005. The petitioner’s reply, if any, is due to be
    filed on or before August 15, 2005. Public comment is due to be filed on or before July 25,
