HEARING OFFICER ORDER
On July 7, 2005, the parties participated in a telephone status conference with the hearing
officer. Settlement discussions had been delayed pending the Illinois Environmental Protection
Agency’s review of the proposed supplemental environmental project. The SEP was not
approved. The parties have now agreed to a penalty amount, and continue to finalize language
for the proposed stipulation and settlement agreement.
The parties are directed to participate in a telephone status conference with the hearing
officer at 10:00 a.m. on September 8, 2005. The telephone status conference will be initiated by
the complainant.
