SETTLEMENT AGREEMENT
Now comes the Complainant, County ofVermilion,
Illinois, by and through
Assistant State’s Attorney Jennifer Riggs, and the Respondent, Bill Wernigk, by and
through his attorney, Thomas Gordon, and submit to the Pollution Control Board the
following stipulation and settlement agreement:
1.
Respondent, Bill Wernigk, admits violating 415 ILCS 5/2l(p)(l), as alleged in
Administrative Citation 05-28 and agrees to pay the penalty for that violation.
2.
The County ofVermilion moves to withdraw, in AC 05-28, the paragraph
alleging a violation of415
I1LCS 5/2l(p)(7).
3.
County ofVermilion agrees
to accept, and Respondent agrees to
give,
payment on such violation each month.
The payment plan will be as follows:
a.
Respondent will pay $125.00
to the Vermilion County Health
Department each month until the violation amount of$3000 is paid in
full.
b.
Payment must be received by the Vermilion County Health
Department on or before the
15th
ofeach month.
c.
Respondent shall make the first payment to
the Vermilion County
Health Department on or before July
15,
2005.
Respondent shall make
the final payment for the violation on or before June
15,
2007.
Complainant and Respondentpray the Illinois Pollution Control Board enter an
order reflecting this agreement.
