HEARING OFFICER ORDER
On June 30, 2005, a telephonic status conference was held. Respondent did not appear.
The complainant informed the hearing officer that settlement negotiations continue, and that a
penalty demand is being considered by the respondent. The Illinois Environmental Protection
Agency has approved two supplemental environmental projects that are part of the penalty
demand. It was agreed that respondent’s answer is due on or before September 30, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on September 15, 2005, at 11:00 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
