HEARING OFFICER ORDER
On June 30, 2005, all parties participated in a telephonic status conference with the
hearing officer. Legislation that will apparently resolve the above-captioned matter has been
passed and is awaiting the Governor’s signature. Once signed, it is anticipated that the
petitioners will withdraw its siting application and re-file a second application with the
respondent for its review. If approved, the petitioner anticipates that it will file a motion to
voluntarily dismiss. The petitioners represented that they will file an open waiver of the
statutory decision deadline.
The parties or their legal representatives are reminded that a telephonic status conference
with the hearing officer is scheduled for September 29, 2005, at 11:00 a.m. The telephonic
conference must be initiated by the petitioners, but each party is nonetheless responsible for its
own appearance. At the conference, the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing.
