HEARING OFFICER ORDER
On June 23, 2005, the petitioner informed the hearing officer that a settlement agreement
has been reached but that the reimbursement application is being reviewed by the respondent and
is optimistic that this matter will be resolved prior to the next status conference. The petitioner
represented that it will file a 60-day waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on August 25, 2005, at 10:00 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing. If, however, a motion to voluntarily
dismiss is filed prior to the next status conference, the conference will be cancelled without
further order.
