    HEARING OFFICER ORDER

On June 23, 2005, all parties participated in a telephonic status conference with the
hearing officer. The respondent represented that settlement discussions have been ongoing but
that the Illinois Environmental Protection Agency (Agency) has rejected the Supplemental
Environmental Project (SEP) submitted by the respondent for the second time. The respondent
represented that it anticipates that it will forward an offer of settlement without the SEP to the
complainant within the next 14 days.

By agreement, all timelines in the discovery schedule has been extended an additional
    seven days.

The parties or their legal representatives are directed to appear at a telephonic status
conference with the hearing officer on August 25, 2005, at 9:45 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the conference the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing.

    IT IS SO ORDERED.
