HEARING OFFICER ORDER
On June 23, 2005, respondents Wooten Construction, Ltd., and Smithfield Properties
L.L.C., (Wooten) represented that they are proceeding with discussions with their consultant and
affected homeowners regarding an attempt to resolve this matter. Wooten also represented that it
has discussed options regarding remediation, including deed restrictions, with the president of
the homeowner’s association and that the president will present, along with Wooten, the issues
before the association. The complainant represented that it and the

remain optimistic that a settlement will be reached.
The parties or their legal representatives are directed to appear at a telephonic status
conference with the hearing officer on August 25, 2005, at 10:15 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the conference the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing.
