a facility
located
in
the
Southwest
Quarter of
Section
Eleven
(11)
in
Township Four (4) South of the Base Lineand Range’Four (4)Westof the Fourth Principal Meridian
in
Baylis,
Pike County,
Illinois.
The property
is commonly known
to
the
Illinois
Environmental
Protection
Agency as New Salem/Tedrow.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating Permit and is designated with
Site Code
No. 1498160006.
3.
That Respondents have owned and operated said facility’ at all times pertinent hereto.
4.
That
on
May
2,
2005,
Michelle
Cozadd
of
the
Illinois
Environmental
Protection
Agency’s
Springfield
Regional
Office
inspected
the
above-described
facility.
A
copy
of
her

inspection
report setting
forth
the results
of said
inspection
is
attached
hereto
and
made a part
hereof.
VIOLATIONS
Based
upon direct observations made
by Michelle Cozadd during the course of her May 2,
2005 inspection
of the
above-named
facility,
the
Illinois
Environmental Protection
Agency
has
determined that Respondents have violated the Illinois
Environmental Protection Act (hereinafter,
the “Act”) as follows:
(1)
That
Respondents
caused or allowed the
open
dumping
of waste
in
a
manner
resulting
in
litter,
a
violation
of
Section
21(p)(1)
of the Act,
415
ILCS
5/21(p)(1)
(2002).
CIVIL PENALTY
Pursuant to Section 42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2002),
Respondents are
subject
to
a
civil
penalty of
One Thousand
Five
Hundred
Dollars
($1,500.00)
for
each
of
the
violations
identified
above,
for
a total of
One Thousand
Five
Hundred
Dollars
($1,500.00).
If
Respondents
elect not
to
petition
the
Illinois
Pollution
Control
Board,
the
statutory
civil penalty
specified above shall be due and payable no later than July 15,2005, unless otherwise provided by
order of the Illinois
Pollution
Control Board.
IfRespondents elect to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31.1
of the Act, 415 ILCS 5/31.1(2002), and if the Illinois
Pollution Control Board issues a finding of violation asaRegedherein, after an adjudicatory hearing,

Environmental Protection Agency and has been so employed at all times pertinent

1:50 PM, Affiant conducted an inspection ofa
disposal site operated without an Illinois Environmental Protection Agency permit,
located in Pike County, Illinois,
and known as New Salem/Tedrow by the Illinois
Environmental Protection Agency.
Said site has been assigned site code number LPC
#1498 160006 by the Illinois Environmental Protection Agency.

The purpose ofthis memorandum is to serve as the narrative for a follow-up inspection conducted on May
2,
2005 at the above referenced site.
Bill Zierath, DLPC/FOS,
accompanied me during the inspection that
took
place from approximately
1:15 pm to 1:50 pm.
The weather conditions were sunnyand
50°F.
Twenty-five
digital photographs were taken to document the conditions ofthe site.
No one was
interviewed, during the inspection.
The site was initially inspected on March 29, 2005.
An Open Dump Administrative Warning Notice
(“ACWN”) was sent to Mr. &
Mrs.
Tedrow for apparent open dumping and open burning violations.
Mr.
Tedrow called me on April
12,
2005 to discuss the ACWN.
I
reminded him that May
1,
2005 was the
established cleanup deadline and to submit the required written response
to the allegations as outlined
in
the
ACWN.
Mr. Tedrow failed to submit the required written response in reply to the ACWN.
I spoke to
Mr. Tedrow again via telephone on
April 29, 2005 where we discussed the required cleanup.
I told him
that I would contact him upon
arrival at the site on the
following Monday.
I explained
that I could not
set
a specific
time for the inspection due to other follow-up inspections that Mr. Zierath and I were conducting
in the morning.
Mr. Tedrow explained that he might not be available to meet with us.
Upon
arrival
at the site
on May 2, 2005, I called Mr. Tedrow (217.833.2565) and spoke to his son who
informed us that Mr. Tedrow was not able to meet with us.
After the phone~
call, Mr. Zierath and I
proceeded with the inspection.
The area on
the
south side ofthe property was inspected first.
The

metal, two used tires and other miscellaneous debris
scattered on
the
ground.
Scrap metal, an animal carcass, and used tires

illustrated in the attached photo #001

During the March 29, 2005 inspection, a pickup truck
full oftrash was parkedjust south ofthe barn.
The attached photo #002 shows the area just east of the
house where the pickup truck was located.
The pickup truck had been removed from the site.
At the
conclusion of the inspection, we drove by
Mr. Tedrow’s property to the north and I observed the pickup
truck on
his
property.
The bed of the
truck
was
still
full
of trash.
An Area Disposal dumpstçr was
observed near the
truck.
During the March 29,
2005
inspection, I observed a second truck
with the
truck
bed
full of trash on the
north side ofthe house.
This same truck was observed at the site during
the May 2, 2005 inspection but
now was
located north of the barn.
The attached photo #006 shows the contents ofthe truck bed;
The
same waste was still present in the truck bed since the previous inspection.
An overview ofthis second
truck filled with trash
is
shown in the attached photo #007.
The burn area on the west side of the site had been cleaned up
as shown in the attached photos #008,
through #0 10.
This office received the attached disposal receipts on May 4, 2005.
The receipts indicate
that
14.62 tons ofdebris was disposed at Pike County Landfill on
April 30, 2005.

area.
Scrap metal
and
damaged dimensional lumber were observed at the opening to a small ravine on the west
side ofthe site
as illustrated in the attached photo #011.
The waste in this ravine had remained unchanged
since the previous inspection.
The north end of the property was inspected next.
There appeared to be no change in the condition ofthis
area.

shelters of corrugated metal sheeting, discarded farm equipment and other miscellaneous waste.
A used
tire was observed in the back of a truck as shown in the attached photo #018.
The truck did not have an
engine or front end.
Scrap metal, corrugated metal sheeting, wood posts,
two
used tires,
an extension cord,
wire,
shingies and damaged dimensional
lumber were piled at the entrance to an erosion channel (see
attached photos #019
-
#021).
The two trucks
in the attached
photo #023
have not moved since the March
29, 2005 inspection.
Vehicles at the site are shown in
the attachedphotos #007 through
#0 10, #012 through #0 18, and #023
through #024.

#0 14.
All the vehicles appear unchanged with four exceptions.
One small red compact car
is no
longer present at the site.
The
large red truck fill of trash is north ofthe barn (see attached photo
#007).
The small pickup full
of trash in the front yard is nowacross the road.
Lastly, a van and two cars
were moved from the ceriThr of the site to the east
side of the barn (see attached photo
#015).
The vehicles observed during the inspection appear to havebeen abandoned.
The Illinois Vehicle Code
defines an “abandoned vehicle” as
anyvehicle
in a state of disrepair rendering the vehicle incapable of
being driven in its condition or any vehicle that has not been moved or used for seven consecutive days or
more and is apparently deserted.
The abandoned vehicles observed during the inspection would be
considered “discarded material” and therefore waste.
“Waste”
is defined in Section
3.53
5
of the illinois
Environmental Protection Act as any
“garbage... or other discarded material,
including solid, liquid, semi-
solid,
or contained gaseous material...”
All
the
abandoned vehicles and discarded farm equipment must be
removed from the site and disposed of properly.

The lead acid batteries seen at the site during the previous inspection were not observed during the
