1605, the County ofKankakee (“County”) states as follows:
1.
Complainant, County, is a unit oflocal government to which the Illinois
Environmental Protection Agency has delegated authority to issue
administrative citations pursuant to Section 4(r) of the Illinois
Environmental Protection Act (“Act”), 415 ILCS 5/4(r) (2003).
County
is thus a “delegated unit” and may issue administrative citations under
35 Ill. Adm. Code
108.200.
2.
Respondent, Municipal Trust &
Savings Bank Trust #1605, is
an Illinois
trust, which was the titled owner (at the time ofthe April 25, 2005
inspection) ofreal property located at PIN 09-25-100-006, approximately
18.75
acres vacant land E. North St..Bradley, Illinois.
3.
On April 25, 2005, County inspector Donna Shehane inspected
Respondent’s property.
A copy of her inspection report is attached as
Exhibit
1
and made a part of this Administrative Citation.
4.
Based upon direct observations made by Ms. Shehane during the course
of her inspection, the County has determined that Respondent violated
the Act as follows:

a.
Respondent caused or allowed the open dumping ofwaste in a
manner resulting in litter, in violation ofSection 2l(p)(l) of the
Act, 415 ILCS 5/2l(p)(l)(2003).
b.
Respondent caused or allowed the open dumping ofwaste in a
manner resulting in open burning, in violation of Section 2l(p)(3)
ofthe Act, 415 ILCS 5/2l(p)(3)(2003).
c.
Respondent caused or allowed the open dumping of waste in a
manner resulting in deposition of general and/or clean
construction or demolition debris,
in violation of Section 21(p)(’7)
of the Act, 415 ILCS 5/2l(p)(7)(2003).

Ms. Shehane’s affidavit, attesting to her material actions and
observations, is
attached as Exhibit
2 and made a part of this
Administrative Citation.

Bourbonnais
Township Fire Department Report, dated April 25, 2005,
is
attached as Exhibit 3 and made a part ofthis Administrative Citation.

Based upon the foregoing facts, under Section 42(b)(4-5) of the Act,
415 ILCS 5/42(b)(4-5)(2003), Respondent is subject to a
civil penalty of
One Thousand Five Hundred Dollars ($1,500.00) for each of the three
violations identified above, for a total civil penalty of Four Thousand
Five Hundred Dollars
($4,500.00).

resulted from uncontrollable circumstances, you will not be assessed
hearing costs and you will not have to pay a civil penalty.

civil penalty and/or hearing costs are not paid within the time set
by the Board
in its final order, interest on the amount due will be
assessed against you from the date payment is due and including the date
that payment is received.
11. Ifany civil penalty and/or hearing costs are not paid within the time set

in its final order, the Office of the Illinois Attorney General

GENERAL REMARKS
Jim Greenstreet and I arrived on site at approximately 3:00 pm to conduct an inspection
ofthis site.
The Solid Waste Division had received a complaint that a large amount of
material had been piled on the ground near the railroad tracks on this parcel ofland.
The
weather at the time of this inspection was 64 degrees Fahrenheit, with west winds at 10
mph and clear skies.
As we drove south on 4000
E. Road toward the site, we observed black smoke in the air.
As we got closer we also observed a firetruck pulling up to the site.
We parked the
vehicle, identified ourselves to
the firemen, and proceeded to the burning site.

voluntarily deposes and states as follows:
1.
At all times relevant to the above-captioned Administrative Citation, Affiant was
employed as an inspector by the Kankakee County Planning Department, Solid Waste
Division.
2.
On April 25, 2005 between 3:00 p.m. and 3:40 p.m., Afflant conducted an
inspection
ofthe property located at PiN 17-09-25-100-006, approximately 18.75
acres of
vacant land E. North St., Bradley, IL by the Kankakee County Planning Department,
Solid Waste Division.
3.
Affiant conducted
an onsite inspection, which included walking around the property
and photographing the site.
4.
In connection with this inspection, Afflant completed the Inspection Report appended
to and made part ofthe above-captioned Administrative Citation, which is an accurate
record ofAfflant’s observations and factual conclusions with respectto this site.
