HEARING OFFICER ORDER
On April 7, 2005, the Board issued an order authorizing respondents to conduct discovery
on the issue of attorney fees. The order did not address whether complainant could conduct
discovery. On May 18, 2005, respondent filed a motion to strike complainant’s interrogatories,
document request and deposition notices on the grounds that complainant was not authorized to
conduct discovery. Complainant’s response, filed on June 1, 2005, argued that discovery is
necessary to demonstrate the reasonableness of the fee request. The hearing officer will refer
respondent’s motion to the Board for a ruling on complainant’s right to conduct discovery.
The parties are directed to participate in a telephone status conference with the hearing
officer at 2:30 p.m. on July 7, 2005. The status conference shall be initiated by the complainant.
