    ORDER OF THE BOARD (by T.E. Johnson):
     
    This matter is before the Board on a petition filed by Jo’Lyn Corporation (petitioner)
    asking the Board to review a determination of the Illinois Environmental Protection Agency
    (Agency). The petition was filed in regards to petitioner’s paving dust suppressant material
    manufacturing facility in Harvard, McHenry County.
     
    On May 24, 2005, the petitioner filed a motion to dismiss the petition. In the motion, the
    petitioner asserts that the parties have agreed that petitioner does not need a waste permit at this
    facility. Accordingly, the petitioner moves for voluntary dismissal of this petition. The motion
    is granted. The Board hereby dismisses the petition, and closes the docket.
     
    IT IS SO ORDERED.
