of the Illinois Environmental Protection Act, 415

FACTS
1.
That
Larry
Beam
(“Respondent”)
is the
present
owner
and
operator of a facility
located
adjacent to
the Cambridge Municipal Landfill,
east of Cambridge,
Henry County,
Illinois.
The
property
is
commonly
known
to
the
Illinois
Environmental
Protection
Agency
as
Cambridge/Beam
Property.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating
Permit and is designated with Site Code No. 0738055001.
3.
That Respondent has owned and operated said facility at all times pertinent hereto.
4.
That on January31,
2003, Jeff Port of the Illinois
Environmental Protection Agency’s
Peoria Regional Office inspected the above-described facility.
A copy of his inspection report setting
forth the results of said
inspection is attached
hereto and
made a part hereof.
VIOLATIONS
Based
upon direct observations made by Jeff Port during the course of his January 31, 2003
inspection of the above-named facility, the Illinois Environmental Protection Agency has determined
that
Respondent has violated
the Illinois Environmental
Protection Act (hereinafter, the “Act”) as
follows:
(1)
That
Respondent
caused
or allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a violation
of
Section
21(p)(1)
of
the Act,
415
ILCS
5/21(p)(1)
(2000).
(2)
That
Respondent
caused
or allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
open
burning,
a
violation
of
Section
21(p)(3)
of
the Act,
415
ILCS
5/21 (p)(3)
(2000).
(3)
That
Respondent
caused
or allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
deposition
of
general
construction
or
demolition
debris
or
clean
construction ordemolition debris, a violation of Section 21 (p)(7) of theAct,415 ILCS
5/21 (p)(7) (2000).
CIVIL PENALTY
On
January 24,
2002,
the Pollution
Control
Board
found
that
Respondent
had
violated
subsections
(1),
(3),
and
(7) of Section
21(p) of the Act, 415
ILCS 5/21(p)
(2000),
Illinois EPA
v.
LarryBeam,
AC 2002-028 (January24, 2002).
Pursuantto Section 42(b)(4-5) of theAct, 415 ILCS
5/42(b)(4-5) (2000), Respondent is subject to a civil penalty of Three Thousand Dollars ($3,000.00)
for the second offense of each of theviolations idenffliedabove, for a total of Nine Thousand Dollars
($9,000.00).
If Respondent
elects not to petition the Illinois Pollution Control Board, the statutory

civil penalty specified
above shall be due and payable no later than April 30, 2003, unless otherwise
provided
by order of the Illinois
Pollution Control Board.
If Respondent elects to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board
in accordance with Section 31.1
of the Act, 415 ILCS 5/31.1(2000), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, afteran adjudicatoryhearing,
Respondent shall be assessed the associated hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board.
Those hearing costs shall
be assessed
in
addition
to the One Thousand
Five
Hundred Dollar ($1,500.00) statutory civil penalty for each
violation.
Pursuant to Section 31.1 (d)(1) of the Act, 415 ILCS 5/31.1
(d)(1)
(2000), if Respondent fails
to
petition orelect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35)
days of the date of service,
the Illinois
Pollution Control
Board shall
adopt
a
final
order,
which shall include
this
Administrative
Citation
and
findings
of violation
as
alleged
herein, and shall impose the statutory civil penalty specified
above.
When
payment
is
made,
Respondent’s
check
shall
be
made
payable
to
the
Illinois
Environmental
Protection
Trust
Fund
and
mailed
to
the
attention
of
Fiscal
Services,
Illinois
Environmental
Protection Agency,

said Petition for Review shall be filed with the Illinois Environmental Protection Agency’s Division of

Affiant is a field inspector employed by the Land
Pollution Control Division of the Illinois Environmental
Protection Agency and has been so employed at all times pertinent
hereto.

Affiant conducted an inspection of the open dump in Henry County,
Illinois, known as the Beam Property,
Illinois Environmental
Protection Agency Site No.
0738055001.

Affiant inspected said Beam Property open dump site by
an on-site inspection, which included walking and photographing
the site.

As a result of the activities referred to in
Paragraph
3 above, Affiant completed the Inspection Report form

Narrative
On
January 31, 2003,
I (Jeff Port) performed a follow-up inspection at the Larry Beam property
located
near
Cambridge,
Illinois
in
Henry
County.
The
purpose
of the
inspection
was
to
determine
if
compliance
had
been
achieved
with
respect
to
the
September
27,
2000
Administrative
Citation Warning Notice.
The notice
was sent
in
response
to
a
September
3,
2000
complaint
investigation
(C-00-090-P).
Inspections
performed
on
June
26,
2001
and
October 26,
2001, revealed that the violations previously observed were-found to be continuing.
I arrived at the site at
12:47 PM.
The weather was overcast and cold, approximately
30 °F. The
gate
to
the
site was open
and
no
one
was
present
when I
arrived.
I
parked
my
vehicle and
proceeded through the gate.
Piles ofasphalt were observed as I walked onto
the property.
They
can be
seen
in photographs
P1
and
P2.
Photograph P3
shows
an
accumulation of waste
tires
between some
semi
trailers
that
appeared
to
be
used for storage.
Photographs
P4
through
P6
show a small
pile of waste that
included waste
tires, processed wood,
a mattress,
and landscape
waste.
Photographs
P7 through
P12 were
taken along the east edge of the property
and
show
several pieces ofconcrete dumped along the edge of the ravine.

a
pile
of concrete
slabs
near the
north
central
part of
the
site.

an
accumulation of tires
on the
west edge of the property.

large burn pile.
This pile
was present during previous inspections.
More waste appeared to have
been dumped here since the October 26,
2001, inspection.
The waste included furniture, carpet,
demolition
debris,
scrap metal,
and
landscape waste.

brick near the center ofthe property.

a pile of
ground asphalt that appeared to have been dumped recently.
