STATUS REPORT
Now comes the Illinois Association ofWastewater Agencies by its attorney, Roy M.
Harsch and Gardner Carton & Douglas LLP and files a Status Report in conformance with the
Rearing Officer’s March 3, 2005 Order.
1.
Representatives ofIllinois Association ofWastewater Agencies (“JAWA”) have
been in contact with representatives ofthe Illinois Environmental Protection Agency (“IEPA”),
the Department ofNatural Resources (“DNR”) and other stakeholders regarding a numberof
issues. There have been ongoing discussions regarding certain technical issues.

A stakeholder meeting was held in Springfield on May 4, 2005 at which time
progress was made at arriving at a position by the Illinois Department ofNatural Resources and
Illinois Environmental Protection Agency. While no formal position has been apparently
reached, further discussions have been held between the two agencies.

Based upon the discussions at the May4, 2005 stakeholder meeting, it was
generally agreed that we should attempt to schedule a third hearing. To that end, the undersigned
has sent e-mails to all ofthe stakeholders regarding possible dates for this hearing. Based upon
the reply from JEPA, DNR, JAWA and several others, it would appear that August 11, 12 and 25
are dates that those who responded can make. There has been no response from Prairie Rivers,
Sierra Club or their representative.
4.
IAWA requests that the Hearing Officer schedule a hearing on one ofthese days
so that this matter can move forward.
