    HEARING OFFICER ORDER
     
    On May 26, 2005, the parties participated in a telephone status conference with the
    hearing officer. Petitioner has obtained new legal counsel, and he will file an appearance in this
    matter. The parties are now making progress on settlement discussions that may not be
    contingent upon completion of the new regional water treatment facility in Shelbyville, Illinois.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 9:00 a.m. on July 21, 2005. The status conference shall be initiated by the petitioner.
    At the status conference, the parties must be prepared to discuss the status of the above-captioned
    matter.
     
    There is an open waiver of the decision deadline in this docket.
