On April
19, 2005,
the Chemical Industry Council ofIllinois
(CICI) filed a proposal for
rulemaking.
CICI seeks to amend Part 201
of the Board’s air pollution regulations.

CICI proposes to amend the Board’s exemptions to statepermitting requirements to

include an exemption for plastic injection molding operations.
The Board accepted this matter
for hearing on May
5,
2005.
On May 19, 2005, CICI filed a motion for expedited review ofthe hearing schedule in
this rulemaking.
CICI contends that expediting this rulemaking will provide timely clarification
ofexisting state permitting requirements.
CICI also states it would bear the
costs ofpreparing an
expedited transcript ofthe first hearing.
Board procedural rules provide that neither the Board
nor the hearing officer will grant any motion before the expiration ofthe 14-day response period,
unless it would result in undue delay or material prejudice.

In order
to avoid undue delay, the hearing officer will rule on CICI’s motion before the expiration ofthe
response period.
After consultation with CICI and the Agency, the hearing officer has expedited the
scheduling ofhearings in this
docket, as indicated in the hearing notice.
Transcripts will be
expedited and the scheduling ofhearings in this docket is indicated in the hearing notice.
Transcripts will be expedited at CICI’s expense.
The Board will expedite its review ofthe
hearing record, consistent with resource and time constraints.
The Board does not expect to hold more hearings than the two hearings scheduled for
July
1 and
15,
2005.
The Board will hold at leasttwo hearings in this matter.
Both hearings will
be conducted
to allow the proponent and all other interested parties the opportunity to present testimony on the
merits and economic impact ofthe rulemaking proposal.
At hearing, all persons who testify will
be sworn in and subject to questioning.
The Board will also receive any testimony on any
economic impact study (EcIS) conducted by the Department ofCommerce and Economic
Opportunity (DCEO) on the proposed rules
or any DCEO decision not to perform an EcIS.
CICI’s proposal
(R05-20),
including the statement ofreasons and proposed amendatory
language, may be obtained on the Board’s website through the Clerk’s Office On-Line (COOL)
at www.ipcb.state.il.us.
The “Notice List”
is the list ofinterested persons who wish to receive only the Board’s
opinions and orders and hearing officer orders in this proceeding.
The “Service List”
is the list of
persons who wish to participate in the proceeding and receive not only opinions and orders, but
also all prefiled testimony and public comments.
To be placed on either the Notice List or the
Service List please either email, fax, or fill
out the attached form and return to the Board address
provided on that form.
Anyone who plans to testify at either hearing must prefile their testimony.
All testimony
for the first hearing must be submitted no later than Thursday, June 16, 2005.
All testimony for
the second must be submitted no later than Friday, July 8, 2005.
Timely submission ofthese
materials by all persons is essential to expedited handling ofthis docket.
