FACTS

That James Stutsman (“Respondent”) is the present owner and operatorof a facility
located
at
8443 County
Road

Bath,
Mason
County,
Illinois.
The property
is commonly
known to
the Illinois Environmental Protection Agency as Bath/Stutsman.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection
Agency Operating Permit and
is designated with Site Code No.
1250055002.
3.
That Respondent has owned and operated said facility at all times pertinent hereto.
4.
That on
April
1,
2005,
Michelle
E.
Cozadd of the
Illinois
Environmental
Protection
Agency’s
Springfield
Regional
Office
inspected
the
above-described
facility.
A
copy
of
her
inspection report
setting
forth
the results
of said
inspection
is attached
hereto
and
made
a part
hereof.

VIOLATIONS
Based upon direct observations made by Michelle Cozadd during the course of her April
1.
2005
inspection
of the
above-named
facility,
the
Illinois
Environmental
Protection
Agency
has
determined that Respondent has violated the Illinois Environmental Protection Act (hereinafter, the
“Act”) as follows:
(1)
That
Respondent
caused
or
allowed
the
open
dumping
of waste
in
a
manner
resulting
in
litter,
a
violation
of
Section
21(p)(1)
of the
Act, 415
ILCS
5/21(p)(1)
(2002).
(2)
That
Respondent
caused
or allowed
the open
dumping
of
waste
in
a
manner
resulting
in
deposition
of
general
construction
or
demolition
debris
or
clean
construction or demolition debris, a violation of Section 21 (p)(7) of the Act, 415 ILCS
5/21 (p)(7) (2002).
CIVIL PENALTY
Pursuant to
Section
42(b)(4-5) of the Act, 415
ILCS
5/42(b)(4-5)
(2002),
Respondent
is
subject
to
a
civil
penalty
of One
Thousand
Five
Hundred
Dollars
($1,500.00)
for
each
of
the
violations identified above, fora total of Three Thousand
Dollars ($3,000.00).
If Respondentelects
not to petition the Illinois Pollution
Control Board, the statutory civil penaltyspecified above shall be
due
and
payable
no
later than
June
15,
2005,
unless otherwise
provided
by order of the Illinois
Pollution
Control Board.
If Respondent elects to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31.1 of the Act, 415 ILCS 5/31.1(2002), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondent shall be assessed the associated hearing costs incurred bythe Illinois Environmental

Protection Agency and the Illinois Pollution Control Board. Those hearing costs shall be assessed
in
addition
to the
One Thousand
Five
Hundred
Dollar ($1 ,500.00) statutory civil penalty for each
violation.
Pursuant to
Section 31.1 (d)(1) of the Act, 415 ILCS 5/31.1 (d)(1) (2002),
if Respondent fails
to petition or elects not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35) days of the date of service,
the Illinois Pollution

adopt

order,

shall

this Administrative
Citation

of
violation
as
alleged
herein, and shall impose the statutory civil penalty specified
above.

Affiant is a field inspector employed by the Division ofLand Pollution Control ofthe
Illinois
Environmental Protection Agency and has been so employed at all times pertinent
hereto.

disposal site operated without an Illinois Environmental Protection Agency permit,
located in Mason County,
Illinois, and known as BathlStutsman by the Illinois
Environmental Protection Agency.
Said site has been assigned site code number LPC
#1250055002 by the Illinois Environmental Protection Agency.

Affiant inspected said Bath /Stutsman open dump site by an on-site inspection that
included walking and photographing the site.

The purpose ofthis memorandum is to serve as the narrative for an inspection conducted on
April
1, 2005 ofthe above referenced site.
The inspection
took place from
about 9:25 am to
11:00 am.
The weather conditions were
sunny and approximately 50°F. Eighty-one digital
photographs were taken
to document the conditions of the site.
No one was interviewed during
the inspection.
An initial complaint investigation was conducted
at this site on July 9,
1999.
An Administrative
Citation Warning Notice (“ACWN”) was sent to
Mr. Stutsman for apparent open dumping
violations.
The first compliance deadline was set for December
15,
1999.
Mr. Stutsman called
on October
12,
1999 to
request a meeting at the site.
Mr.
Charlie King, DLPC/FOS and myself
‘conducted an October
14,
1999 site visit to discuss the corrective action needed to bring the site
into compliance.
A Consensual Tire Removal
Agreement form was sent on November
15,
1999
to notify Mr. Stutsman of the available assistance to remove the used tires once all the other
waste materials at the site were disposed or recycled properly.
Mr.
Stutsman called on December
9,
1999 to
request a second meeting at the site to evaluate the progress made at the site.
A re-
inspection was conducted on December 20,
1999.
During the re-inspection, Mr. Stutsman
requested a time extension to complete the cleanup.
The cleanup deadline was extended to April
1, 2000 per his request.
-
I conducted a re-inspection on October 18, 2000 where continuing apparent violations ofopen
dumping were noted.
A November 8, 2000 letter was sent to Mr. Stutsman requesting a written
response to be
submitted to the Illinois
EPA no later than November 20, 2000.
The written
response was to
contain a cleanup proposal including a timetable for the completion of the
corrective action.
Mr. Stutsman response was received by facsimile on November 16, 2000.
The
response stated “I
will work on
it as often as possible.”
A January 4, 2001
letter was sent to Mr.
Stutsman stating that his
response failed to
include a plan and timetable to bring the site into
compliance.
The letter asked for a second
submission of a correction action plan and timetable
to be
submitted by January 20, 2001.
Mr. Stutsman submitted
a January 11, 2001
facsimile that
included details about segregating the
scrap metal, tires, appliances, landscape waste into
separate piles.
Mr. Stutsman
also requested a May
1, 2005
cleanup deadline.

A June
17, 2002 re-inspection was conducted to evaluate the progress ofthe cleanup at the site.
A July 23, 2002
letter from the Illinois EPA to Mr. Stutsman stated that substantial progress must
be made to dispose or recycle the waste at the site prior to the next re-inspection.
Mr. Stutsman
was also
informed that his
January 12, 2001
proposal to
finish the cleanup
by May 1,2005
is not
acceptable if substantial
progress has not been made.
Continuing open dumping violations were
cited during an August 27, 2002 re-inspection.
The September
17, 2002
letter from the Agency
requested a copy ofMr. Stutsman’s
Secretary of State’s salvage license.
In addition,
Mr.
Stutsman was to advise the Illinois EPA when he
completed covering the used tires not mounted
on rims
and removing the lead-acid batteries for recycling.
The Illinois EPA received no
response from Mr. Stutsman concerning this
letter.
Upon arrival at the site on April
1, 2005,
I inspected the area north of the mobile home and
garage as shown in the attached photos #001
through #008.
The area contained 30+ used tires, a
wagon full ofdamaged
dimensional lumber, metal tanks,
10+ abandoned vehicles, burn barrels,
corrugated metal sheeting, a boat, tractors, propane tank, gas cylinders, farm equipment, a trailer,
metal frames,
scrap metal and other miscellaneous debris.
The red truck in the attached photo
#004
is in the same spot as observed during the July 9, 1999 inspection.
Debris
is also located along the western edge of the sand road as shown in
the attached photos
#009, #012,
#0 16, #048, #049, #058
and
#075.
The debris included used tires, axles, scrap
metal, damaged dimensional lumber and miscellaneous debris.
The attached photos #010
and #011
show the area in
front of the garage.
The area included 20+
used tires, scrap metal and three trucks.
Additional 20+ tires and scrap metal were observed
between the garage and the house as shown in the attached photo #022.
There are paths through the areas ofwaste across the entire site.
The entrance to the path to
the
backyard is shown in the attached photo #0 13.
A burn tank was observed on the south side of the
house (see attached photo #018).
The attached photo #017
is a close-up ofthe contents of the
burn tank.
I observed food containers,
plastic bags, metal cans, plastic jugs,
a milk jug,
aluminum
foil, paper, damaged dimensional lumber and paperboard containers on
top of charred
waste and ashes down toward the bottom ofthe tank.
The areas adjacent to the house on the
south
and east sides are illustrated in the attached‘photos #019 and #020, respectively.
These
areas contained used tires, gas cylinders, tractors, a blue pickup truck, equipment, and scrap
metal.
The attached photos #023
through #030 illustrate the area in back ofthe garage.
This area
contained an
abandoned yellow van, a bus full of damaged dimensional lumber, used tires,
buggies, golf carts, a low-boy, a camper, piles ofscrap metal, 3+ tractors, 5+ abandoned vehicles,
concrete blocks and miscellaneous waste materials.

is illustrated in the attachedphoto
#031.
The area south ofthe house and northwest of the RV shed is shown in the attached photos

The southeast corner of this
area
contains two small
sheds, used tires, farm equipment, golf carts and scrap metal (see attached

The eastern edge ofthe area contained golf carts, used tires, scrap
metal, an
abandoned bus, a large green metal enclosed trailer (see attached photos #039, #043
&
#044).
The attached photo #045
shows telephone poles, a tractor,

used tires, car parts, bricks,
scrap metal and miscellaneous debris on southern edge ofarea.
A pile of50+ used tires and
scrap metal is
located near the intersecting corner ofthe two small
sheds.
The large area on the eastern edge of the site to the northeast ofthe RV shed contained two
abandoned mobile homes,
100+ used tires, a wood pallet oflead-acid batteries, corrugated metal
sheeting, concrete blocks,
10+ tractors, a metal drum
full ofinsulated wire, golf carts, a boat,
large metal sheets,
10+ abandoned vehicles, scrap metal and miscellaneous waste materials.
This
area is shown in
the attached photos #02 1, #032 through #038, and #042.
The truck and metal
crates of aluminum cans in the attached photo #021
are in the same spot as observed in the July
9,
1999 inspection.
I observed broken casings on some ofthe lead-acid batteries shown in the
attached photo #033.
Scrap metal and used tires were observed
in the beds ofsome ofthe pickup
trucks.
The attached photo #046 shows the
front ofthe abandoned mobile home just to the west ofthe
large RV shed.
The truck body in front ofmobile home was in same spot during the July 9,
1999
inspection.
A
tow truck, an abandoned pickup truck, scrap metal
and miscellaneous debris were
observed on the west side ofthe mobile home and
RV shed.
A very large metal tank was observed on the south side ofthe RV shed.
Scrap metal, abandoned
vehicles, golf carts, and miscellaneous waste were observed on the south side ofthe metal tank
(see attached photo
#050).
The attached photo #051
shows the used tires, crane, scrap metal and
abandoned vehicles on the east side ofthemetal tank.
The red pickup truck is stacked on top of
another vehicle.
The remaining portion of the site south of the very large metal tank was divided
up with several
paths.
The areajust south ofthe tank contained eight tractors lined up in a row.
The second area
to the south contained 4+ tractors, an abandoned pickup truck, farm equipment, and other scrap
metal as shown
in the attached photo
#054.
The attached photo #054 also shows the 20+ cars,
trucks and other farm equipment stacked two high in the third area south ofthe tank.
The
abandoned vehicles can also be seen in the attached photos
#056,
#057 and #059.
The area to the south of the stacked vehicles contained 4+ abandoned trucks and piles ofscrap
metal.
The next area to
the south contained 7+ large square metal boxes, 4+ metal tanks and
scrap metal.

observed spilled
out ofa crate on the ground.

The eastern edge contained abandoned vehicles, gas grills, large refrigerator shelving, a bathtub,
scrap metal, an abandoned bus, a camper,
farm equipment, piles ofused tires, a pile
oftire rims,
scrap metal and
miscellaneous debris.
The large scrap metal pile on the southern boundary ofthe
site is also shown in
the attached photo #078.
The large broken pieces of concretejust
north of the large pile oftires and northwest ofthe large
scrap metal pile are shown

The large pile of500+ used
tires on the southern end ofthe site is shown in the attached photos #076

This pile of
used tires and the adjacent scrap metal pile
were also observed
at the site during the July 9,
1999
inspection.
There is a significant increase in
the amount of used tires and scrap metal
in these
piles.
In addition, there is an overall increase in the amount of waste materials at the site since
the previous inspection on August 27, 2002.
