    HEARING OFFICER ORDER
     
    On May 17, 2005, a hearing in this matter was held at the James R. Thompson Center,
    100 West Randolph Street, Room 11-512, Chicago, Illinois. Attorney John Privitera appeared
    and participated in behalf of the petitioner. Attorney Robb Layman appeared and participated on
    behalf of the Illinois Environmental Protection Agency (Agency).
     
    Witness Credibility
     
    Based on my observations, experience and legal knowledge, witness credibility is not an
    issue.
     
    Exhibits
     
    Petitioner’s written responses to the Board’s questions, filed May 13, 2005, was admitted
    as hearing officer exhibit 1. No other exhibits were offered.
     
     
    Briefing Schedule
     
    At the hearing, a post-hearing briefing schedule was discussed and agreed to. The parties
    simultaneous post-hearing briefs are due to be filed on or before June 30, 2005. The parties
    agreed that no reply would be necessary. Public comment is due to be filed on or before June 10,
    2005.
