HEARING OFFICER ORDER
  
On May 18, 2005, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that there now appears to be some issues that the Illinois
Environmental Protection Agency has with the stipulation and proposal for settlement
(stipulation). The parties represented that discussions will be initiated addressing those issues.
Respondent is given to July 15, 2005, to replead its affirmative defense to
laches
, if needed, and
the complainant is given to July 29, 2005, to answer respondent’s affirmative defense number 2
not addressed in the Board order of March 4, 2004, if needed.
 
The parties are directed to participate in a telephonic status conference with the hearing
officer on June 29, 2005, at 9:15 a.m. Please note the change in time. The status conference
must be initiated by the complainant, but each party is nonetheless responsible for their own
appearance. At the status conference, the parties must be prepared to discuss the status of the
above-captioned matter and their readiness for hearing. If, however, a stipulation is filed prior to
the next status conference, the conference will be cancelled without further order.
