HEARING OFFICER ORDER
On May 11, 2005, all parties participated in a telephonic status conference with the
hearing officer. The complainant represented that it recently forwarded a penalty demand to the
respondent for review. Once received, the respondent represented that it will review the demand
and continue discussions with the complainant. By agreement, complainant is directed to file its
response to the respondent’s affirmative defenses on or before July 29, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on July 14, 2005, at 9:45 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
