HEARING OFFICER ORDER
On April 28, 2005, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that they are close to agreement on the draft stipulation
and proposal for settlement (stipulation). The respondent represented that it will forward an
application for a construction permit to the Illinois Environmental Protection Agency that is part
of the supplemental environmental project that is to be included in the stipulation. The
respondent made an oral motion for an extension of time to file its answer. The complainant had
no objection. Respondent’s motion is granted. Respondent’s answer is now due on or before
July 8, 2005.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on June 30, 2005, at 10:00 a.m. The telephonic status
conference must be initiated by the complainant, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
