For this Administrative Citation to Municipal Trust & Savings Bank Trust
#1697,
the County of Kankakee (“County”) states as follows:
1.
Complainant, County, is a unit oflocal government to which the Illinois
Environmental Protection Agency has delegated authority to issue
administrative citations pursuant to Section
4(r) ofthe Illinois
Environmental Protection Act (“Act”), 415 ILCS 5/4(r) (2003).
County
is
thus a “delegated unit” and
may issue administrative citations under
35 Iii. Adm. Code 108.200.
2.
Respondent, Municipal Trust & Savings Bank Trust #1697,
is an Illinois
trust, which is the titled owner of real property located at 4661
5. 750 E.
Road, Kankakee, Illinois.
3.
On March 30, 2005, County inspector Donna Shehane inspected
Respondent’s property.
A copy of her inspection report is attached as
Exhibit
1 and made a part of this Administrative Citation.
4.
Based
upon direct observations made by Ms. Shehane during the course
of her inspection, the County has determined that Respondent violated
the Act as follows:

a.
Respondent caused or allowed the open dumping of waste in a
manner resulting in litter, in violation of Section Zl(p)(l) of the
Act, 415 ILCS 5/2l(p)(l)(2003).
b.
Respondent caused or allowed the open dumping-ofwaste in a
manner resulting in open burning, in violation of Section 2l(p)(3)
ofthe Act, 415 ILCS 5/2l(p)(3)(2003).
c.
Respondent caused or allowed the open dumping ofwaste in a
manner resulting in deposition of general and/or clean
construction or demolition debris, in violation of Section 2l(p)(7)
of the Act, 415 ILCS
512l(p)(7)(2003).

Ms. Shehane’s affidavit, attesting to her material actions and
observations, is
attached as Exhibit 2 and made a part of this
Administrative Citation.
6.
Based upon the foregoing facts, under Section 42(b)(4-5) ofthe Act,
415 ILCS 5/42(b)(4-5)(2003), Respondent is subject to
a civil penalty of
One Thousand Five Hundred Dollars ($1,500.00) for each ofthe three
violations identified above, for a total civil penalty of Four Thousand
Five Hundred Dollars ($4,500.00).

GENERAL REMARKS
I arrived on site at approximately 11:50 am, accompanied by Mr. James Greenstreet.
Mr.
Greenstreet is in training for certification as an
Illinois EPA-delegated inspector for
Kankakee County.
The weather at the time ofthis inspection was 73 degrees Fahrenheit
with south winds at 23 miles per hour, and
scattered clouds.
Wewere driving near the site when we observed smoke drifting from the area.
We drove
onto the gravel entrance ofthe site and exited the vehicle to conduct an inspection.

1 was taken to the south and depicts waste/debris burning on site.
We walked
closer to the burn pile, where photos #
2 through # 4 were taken.
Thesephotos reveal the
open dumping and burning ofthe following materials: metal, lumber, carpeting, plastic,
paper, roofing shingles, other construction and demolition debris,
as well as
miscellaneous debris.
Adjacent to this pile to the south, photo

5 was taken.
This photo
reveals metal on the ground and in the corner, smoldering asphalt roofing shingles.
Photo #6, taken toward the north, again depicts the large dump and burn pile. Photo

was taken toward the north, and reveals the smoldering shingles mentioned above, as
well as partially burned metal waste.

We proceeded to inspect the remainder ofthe property.

abandoned gas cylinder on the ground at the site.

It was not clear what the purpose ofthis structure is.

More open dumping ofwaste was observed near the pole building.

waste tires on the ground at the site, as well as various parts ofan automobile (seat, car
door).

abandoned vehicle, as
well as three drums containing waste, and miscellaneous debris on the ground.
Photo # 27 reveals two additional waste tires, as well as automotive batteries on the
ground and exposed to the elements.
Photo # 28 was taken ofadditional waste on the ground, including plastic, paper, waste
containers, and another automotive battery.
More open dumped debris (metal) is seen in
photo #29.

# 30, taken from behind the pole building, shows another abandoned vehicle, and
open dumped vehicle part, as well as a semi-trailer on site.
Photo #31 was taken ofan abandoned boat behind thepole building.

toward the west, depicts a pile ofwaste tires on site, containing approximately 25 tires.
Adjacent to the tires, we observed four industrial drums on site (photos # 33
35).
Debris, including a lawn chair, metal, pallet, and lumber was on the ground around these
drums.
The drums did
contain an unknown liquid and labels were not observed on any of
the drums.

a telephone pole, metal, plastic, and lumber.

insulation, wood, siding, plastic, metal, rubber, and miscellaneous debris.

Before leaving the site, Mr. Greenstreet telephoned the Otto Township Fire Protection
District to put out the smoldering fires.
