HEARING
OFFICER ORDER
This “identical in substance” rulemaking is required by Section 9.1(e) ofthe
Environmental Protection Act (415 ILCS
5/9.1(e)
(2002)) to
update the definition of “volatile
organic material” in the Board’s air pollution regulations
(35
Iii. Adm. Code 211.7150).
The
update is needed to ensure that Illinois’ regulations reflect the United States Environmental
Protection Agency’s most recent
exemption of chemical compounds from regulation as ozone
precursors.
On March 3, 2005, the Board issued an opinion and order in this rulemaking as a proposal
for public comment.
On April
12, 2005, the Board held a public hearing on the proposal.
At
hearing, the hearing officer stated on the record that notice ofthe proposal appeared in the
Illinois Register
on March 18, 2005,
and that therefore the 45-day public comment period would
end on May 2,
2005.
Accordingly, any public comments must be filed with the Clerk ofthe Board by May 2,
2005.
