HEARING OFFICER ORDER
On April 12, 2005, the parties participated in a telephone status conference with the
hearing officer. By the next status conference, respondent will get cost estimates on the
remedies proposed by complainant’s noise expert, and will decide whether to hire its own noise
expert. Complainant expressed concern over respondent’s repeated delays in this case. As
respondent has new counsel, the hearing officer allowed additional time for respondent to work
on this matter. However, if respondent does not make progress, the hearing officer may set an
expedited discovery schedule for hearing.
The parties are directed to participate in a telephone status conference with the hearing
officer at 11:00 a.m. on June 9, 2005. The telephone status conference will be initiated by the
complainant.
