Illinois
Environmental Protection Agency (the “Agency”).
1.
Harvey
B.
Whittaker
(“Petitioner”),
is
the
owner of a
gasoline
service
station
located• at
the
Corner of Federal
and
Main,
Perry,
Pike
County,
Illinois
(the
“Station”).
The
Station
had
underground
storage
tanks
(UST’s) on the property, which stored gasoline and
diesel fuel.
2.
LUST
Incident
Number
971835
was
obtained
following
a
site
investigation.
The
site has
also
been
assigned
LPC #1490705004,
Pike
County.
3.
On November
1,
2004, Petitioner
sent to
the Agency a revised Corrective
Action
Plan
Budget
(the
“Budget”)
to
perform
corrective
action
at
the
Station.
(See
Exhibit
1.)

Agency
received
this
document
on

The
letter
forwarding
the
Budget
stated
that
the
“Budget Amendment is
necessary due
to
the previously approved budgets
being insufficient
to
complete the approved plan.
It has been determined
that
the
requested
amount
will
be
necessary in
order
to
complete
the
approved
work
in
accordance
with
the regulations
and
the
Act.”
(See
Exhibit A,
p.
1.)
The Budget included
signed
certifications
to
the
effect
that
the
submitted
Budget
complied
with
the Environmental
Protection
Act.
(See
Exhibit
1, 3~page.)
JEPA,
on December
5,
2001,
approved the
Corrective Action Plan for which the Budget was submitted.

By
letter
dated
March
2,
2005,
the
Agency
sent
a
letter,
to
Petitioner
rejecting the High Priority Corrective Action Plan Budget (the “Budget”).
(See
Exhibit 2.)
The
letter
stated
that
the
Budget was
rejected
for the
reasons
listed
in
Attached
A.
Attached
A
essentially
stated
that
this
Budget was rejected because a prior budget was rejected.

The Agency’s
letter does not
state that
the Agency
reviewed the Budget
and
provides
no
additional
information regarding why JEPA disapproved
the Budget.
Upon information and belief, the Agency did not review the
Budget.

Section 732.405(e) provides as follows:

Agency

review
and
approve,
reject
or
require
modifications of the
amended plan
in
accordance with
the
procedures contained in Subpart E of this Part.

Under the terms of Section
732.405(e),
the Agency
is required
to
review
the
revised
Budget
in
accordance
with
the
procedures
contained
in
Subpart E
of part
732.
Illinois
EPA has
failed
to
perform
the
detailed
review required by Subpart E, Section 732.505.
8.
Section 47(a) of the Act states as follows:
“The State of Illinois and all its
agencies,
institutions,
officers
and
subdivisions
shall
comply
with
all
requirements,
prohibitions,
and
other
provisions
of
the
Act
and
of
regulations adopted thereunder.”
9.
By
refusing
to
review
the
Budget,
the
Agency
failed
to
comply
with
Section 732.505
and violated Section 47(a) ofthe Act.
10.
Petitioner has determined that revised
cost estimates are necessary in order
to
comply
with the minimum required activities
for
the site and
that
the
costs
IEPA previously
approved
are
not
adequate
to
allow
Petitioner to
comply
with
the
Act
or
to
perform the work
described in
the
approved
CAP.
11.
Petitioner’s
costs to
perform the
work
as
set forth
in
the revised Budget
are reasonable costs.
12.
Petitioner
is
appealing
the
Agency’s
continuing
failure
to
review
the
Budget
in
compliance
with
the
Act
and
its
implementing
regulations.

implement the CAP approved for Shad’s Service on December

The CAP Budget
Amendment is necessary due
to the previously approved budgets being insufficient to
