    HEARING OFFICER ORDER
     
    On April 7, 2005, the parties participated in a telephone status conference with the
    hearing officer. Respondent has received petitioner’s revised ELUC (Environmental Land Use
    Covenant). Respondent is now prepared to send petitioner approval of the ELUC, along with a
    letter stating that no further remediation is needed at the site. Once these letters are recorded,
    petitioner will be prepared to dismiss this appeal. Petitioner agreed to file a waiver of the
    decision deadline to August 31, 2005 within the next seven days.
     
    The parties are directed to participate in a telephone status conference with the hearing
    officer at 10:00 a.m. on May 9, 2005. The status conference shall be initiated by the petitioner.
    At the status conference, the parties must be prepared to discuss the status of the above-captioned
    matter.
     
    The decision deadline is currently July 21, 2005.
