HEARING OFFICER ORDER
On April 1, 2005, the parties participated in a telephone status conference with the
hearing officer. The parties are hoping to resolve this appeal in conjunction with PCB 03-22
People v. Saint-Gobain Containers. The parties are going to meet one more time in that case to
determine whether they can agree on a penalty amount. If settlement negotiations reach an
impasse, petitioner will need to decide how to proceed with this permit appeal.
The parties are directed to participate in a telephone status conference with the hearing
officer at 10:45 a.m. on May 5, 2005. The status conference shall be initiated by the petitioner.
At the status conference, the parties must be prepared to discuss the status of the above-captioned
matter.
Petitioner filed an open waiver of the decision deadline in this matter.
