    ORDER OF THE BOARD (by T.E. Johnson):
    This matter is before the Board on a petition filed by Phibro-Tech formerly Southern
    California Chemical Company, a division of CP Chemicals, Inc. (Phibro-Tech) asking the Board
    to review a determination of the Illinois Environmental Protection Agency (Agency). The
    petition was filed in regards to certain conditions imposed by the Agency in Phibro-Tech’s
    closure plan permit for a site located in McHenry County.
    On March 3, 2005, Phibro-Tech filed an agreed motion to voluntarily dismiss the appeal.
    In the motion, Phibro-Tech asserts that, pursuant to an agreement of the parties, the Agency has
    issued a closure plan approval letter that supercedes the approval letter first issued in 1992.
    Phibro-Tech requests that the case be dismissed with prejudice and without costs. Phibro-Tech
    asserts that the Agency agrees to the dismissal of the case. The motion for voluntary dismissal is
    granted. The Board hereby dismisses the petition, and closes the docket.
