    ORDER OF THE BOARD (by J.P. Novak):
     
    On March 14, 2005, the parties timely filed a joint notice to extend the 35-day period
    within which Clinton County Oil Company, Inc. (Clinton County Oil Company) may appeal a
    February 2, 2005 determination of the Illinois Environmental Protection Agency (Agency).

    415 ILCS 5/40(a)(1) (2002); 35 Ill. Adm. Code 105.402, 105.406. Clinton County Oil Company
    requested on February 8, 2005 that the Agency request a 90-day extension of time to file a
    petition. Request for Ninety Day Extension of Appeal Period at 1, Exhibit B. Because the
    postmark date of the joint request is within the time for filing, the joint request was timely filed.
    35 Ill. Adm. Code 101.300(b)(2), 105.404. The Agency denied the request for reimbursement
    from the UST Fund of certain costs of corrective action for Clinton County Oil Company’s
    leaking underground petroleum storage tank facility located at 13655 John Drive, Highland,
    Madison County.
     
    The Board extends the appeal period until June 8, 2005, as the parties request.

    an appeal on or before that date, the Board will dismiss this case and close the docket.
